Well, it seems kind of crazy that they would take legal action to get back less than $1,000, but...
That said, verbal agreements are generally not worth the paper they are written on. It seems hard enough to discuss breach or intent logically with written agreements, let alone oral. It is my thinking that unless you could get person or persons from the previous admistration to place in writing that there was a binding agreement and the nature of that agreement.
It should also be noted that dunking much more than your big toe into the legal pool will no doubt cost you well over $1,000. Thus it's not often about right and wrong, but about "what's this gonna cost me?"
Let me state that I am not a lawyer and that anything I write here is with the desirte to provide suggestions that may or may not work.
You received $950 that you consider to be past due payment for services. (discounted) You might want to draft a letter, listing their check number and amount and in the letter say that you accept this payment for past due amounts owed. Send the letter to their accountingdepartment and manager, along with any type of accounting that might show (even a simple ledger print out).
IF it works, great. If not, you at least have a letter in writing that states the nature of a debt to you. The fact that you have discounted the debt may make somebody say - oh the heck with it.
You do want to check with some competent counsel before accepting any advise.

I should also say that most actors I know, even those who are paid exclusively through union contracts deal with having to dischrage debt from time to time. We are "businesses" and this is a part of doing business. |
